MEMORANDUM OPINION
HUVELLE, District Judge.
Plaintiffs Jong-Joon Chun and his sister, Sun Duk Chang, have sued the Secretary of State alleging that the refusal to issue a visitor’s visa to an applicant with a pending immigrant petition is a violation of the Immigration and Naturalization Act (“INA”), 8 U.S.C. § 1104(e), “which places upon the General Counsel of the Visa Office, the authority to ‘maintain contact with the appropriate officers of the Service with a view to securing uniform interpretations of the law’ ” (Complaint ¶ 21), and is “contrary to law, in that it is clearly a violation…
