Plaintiff is the widow of Kenneth Susan, an employee of Susan & Sons, who received fatal injuries on March 7, 1938, while removing a brew tank from a building in the city of Niles, said tank belonging to the defendant Universal Brewing Equipment Company. His employer was not subject to the provisions of the workmen’s compensation act. See Act No. 10, Pub. Acts 1912 (1st Ex. Sess.), as amended (2 Comp. Laws 1929, § 8407 et seq. [Stat.
