delivered the opinion of the court.

This is an appeal from a judgment rendered in an action of assumpsit by appellee against appellant for clerkly services alleged to have been performed by the former for the latter. The declaration contains a special count averring a contract to pay appellee for his services $75 per month, and the common quantum meruit count. The appellant pleaded non-assumpsit only, and the court, by agreement of the parties, appointed George F. Westover sole referee and the cause was referred to him.
