DONALD RUSSELL, Circuit Judge:

Jeffrey MacDonald appeals the district court’s denial of his petition for writ of habeas corpus filed pursuant to 28 U.S.C. § 2255 (1988). MacDonald seeks relief through a second habeas petition from his 1979 conviction for the murders of his wife and two daughters. He presents newly discovered evidence, which, he claims, the government suppressed at trial and which, he also claims, discredits the government’s case against him and corroborates his exculpatory account of the murders.
