— Order of the Supreme Court, Bronx County (Martin B. Klein, J.), entered September *5076, 1984, setting aside defendant-respondent’s convictions, following a trial by jury, on the counts of robbery in the second degree (Penal Law § 160.10 [1]) and assault in the second degree (Penal Law § 120.05 [6]), and directing a new trial as to these counts with the instruction that a guilty verdict not be returned as to one or the other count, unanimously reversed, on the law, the jury verdict reinstated in its entirety and the matter remanded for defendant to be resentenced accordingly.
