[1] This is a motion to quash service of process. The parties are both citizens, the plaintiff a resident of this state, and the defendant of the state of Utah. The action was filed on August 14, 1918, in the superior court of the state at San Francisco, and service of the summons was made on defendant the same date at that place. Thereafter the cause was duly removed here for diversity of citizenship, and the defendant, appearing specially for the purpose, has since interposed the present motion on the ground that he was not legally subject to service in this…
