PROVOSTY, J.

This is a petitory action involving 10 lots of ground fronting on Melpomene street in this city, numbered 1 to 10 and constituting the entire frontage of the square; and also a certain area back of these lots. The side streets are Prieur and Johnson, and the parallel street is Thalia. The square is situated in that part of the c-ity limits which up to recent years was a swamp more or less water covered the year round.
