The plaintiff brings this suit for personal injuries which she allegedly sustained as a result of an assault and battery on her person by the defendant. There was judgment in the trial court dismissing the plaintiff’s suit at her cost, and she has appealed.

The allegations of the petition show that on May 23, 1947, at about the hour of 10:30 a. m., after the plaintiff had attended church services and was leaving the church in company with other members of the congregation, the defendant (without cause or provocation) grabbed her by the throat and made a false accusation…
