Missouri Electric Power Co. v. Smith

Action in equity to enjoin the State Auditor from registering pursuant to Art. 6, Chap. 16, R.S. 1939, Mo. Stat. Ann., p. 760 et seq., Sec. 2914 et seq., $80,000 of Electric Light Bonds of the City of Sullivan, dated April 15, 1940. A preliminary injunction was granted ex parte and plaintiff gave bond in the penal sum of $1500 conditioned "as required by law." Defendant answered and files his motion to dissolve the injunction. On motion of defendant at the close of plaintiff's case, a final decree was entered by which the temporary injunction was dissolved and plaintiff's petition dismissed…
