OPINION
SWEET, District Judge.
Defendant Allen & Co., Inc. (“Allen”) has moved pursuant to Fed.R.Civ.P. 56 for sum mary judgment dismissing the complaint of plaintiff International Mining Co., Inc. (“IMCO”). Allen has also moved pursuant to Fed.R.Civ.P. 37 to dismiss the complaint for IMCO’s failure to comply with certain discovery orders issued by this court. For the reasons stated below, the motions will be granted.
