OPINION

SWEET, District Judge.

Plaintiff Eleanor Monaghan, individually and as a guardian ad litem for her husband *502William Monaghan (“Monaghan,” collectively, the “Plaintiffs”), has moved for an order pursuant to Rule 37(b), Fed.R.Civ.Pro., to strike the Answer of defendant Silverstein 33 Associates, L.P. (“SZS”) and enter a default judgment against SZS on the issue of liability for willful and fraudulent failure to comply with discovery rules.
