Appeal from a judgment of the County Court of Sullivan County (LaBuda, J.), rendered July 15, 2010, convicting defendant upon his plea of guilty of the crime of criminal sexual act in the first degree.
Defendant pleaded guilty to criminal sexual act in the first degree in full satisfaction of a five-count indictment and waived his right to appeal. Prior to sentencing, he moved to withdraw his plea, arguing that he was coerced into pleading guilty. County Court denied the motion and thereafter sentenced defendant to eight years in prison to be followed by five years of postrelease supervision.…
