The plaintiff and the- defendant own adjoining lots bounding southerly on Easton Street in Lawrence, upon each of whiclra part of a double house is located, the plaintiff occupying the west side and the defendant the east. In the rear of the defendant’s house is an open lot upon which he is intending to build a garage and he claims a right of way on foot, with automobiles and other vehicles, from the open lot over the plaintiff’s land in the rear and on the westerly side of the house to Easton Street.
