In this action, originally brought in 1983 by the State of New York against the Solvent Chemical Company, Inc. (“Solvent”), and its parent company, ICC Industries, Inc. (“ICC”), pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”), 42 U.S.C. § 9601, et seq., the court conducted a non-jury trial on issues pertaining to the liability and equitable allocation of responsibility for costs incurred in remediating environmental contamination at Solvent’s property located at 3163 Buffalo Avenue in Niagara…
