This appeal is taken from a judgment of the United States District Court for the Western District of New York (Curtin, J.) that (among other rulings) denied a declaratory judgment of liability for future cleanup costs under the Comprehensive Environmental Response and Compensation Act (“CERCLA”), 42 U.S.C. §§ 9601-9676. Plaintiff Solvent Chemical Company, Inc. (“Solvent”) sued two adjoining property owners, E.I. du Pont de Nemours & Co.
