Appeal from an order of the Supreme Court, Monroe County (William R Polito, J.), entered June 13, 2006 in a personal injury action. The order granted plaintiffs motion for an order setting aside the jury verdict and granting a new trial.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs, the motion is denied and the verdict is reinstated.
