MEMORANDUM OPINION AND ORDER

In this Section 1983 action against the City of New York and New York City Police Officer Jacqueli L. Harper, Plaintiff Menachem Ezagui alleges that defendants violated his due process rights under the Fourth, Fifth, and Fourteenth Amendments of the United States Constitution in connection with seizing and retaining as “arrest evidence” his vehicle and the personal property contained within it.
