In October 1996, The Robert V. Jones Corporation contracted to purchase certain real property from a third party not related to this proceeding. Thereafter, The Sanctuary, Ltd. (“Sanctuary”) was created to develop a residential community project on the property. The petitioner, Lowe Enterprises Residential Partners, L.P.
