OPINION
WECHSLER, Chief Judge.
{1} Defendant Ricky Bennett was convicted of aggravated battery with a deadly weapon against a household member contrary to NMSA 1978, § 30-3-16(0) (1995) and battery against a household member contrary to NMSA 1978, § 30-3-15 (1995, prior to 2001 amendment). On appeal, he asserts that error occurred both at trial and at sentencing.
