OPINION & ORDER
PIERAS, District Judge.
The Court has before it several waves of briefs in these two related actions which address a host of issues—but this litigation is no stranger to difficult and protracted legal battles. In reviewing the appeals that arose out of its first jury trial, Judge Selya, writing for a panel of the First Circuit, characterized the task they faced as an “odyssey.” Dopp v.
