Plaintiff filed an action to recover from the defendant $1,719.85, with interest from May 1, 1934, for moneys which had been paid in advance by plaintiff to defendant for services which defendant failed and refused to perform under an oral contract with the plaintiff. Plaintiff was engaged in the sale of electric refrigerators of the type known and designated as “Frig-idaires.’

As la part of the contract of sale plaintiff gave to the individual customers a twelve months’ guarantee, and agreed during that period to furnish free service. Plaintiff acted as sales agent by virtue of an arrangement…
