Mishick J. Smith appeals from a judgment imposing a sentence of three years’ imprisonment for attempting to obtain money from Mrs. Mae Rhodus by use of a trick, deception and fraudulent representations and pretenses. Section 561.450 RSMo 1949, V.A.M.S., provides: “Every person who, with intent to cheat and defraud, shall obtain or attempt to obtain, from any other person * * * any money, property or valuable thing whatever by means or by use of any trick or deception, or false and fraudulent representation, or statement or pretense * * * shall be deemed guilty of a…
