WELBORN, Commissioner.

This is an appeal by Lester King from.a judgment of conviction in the Saline County Circuit Court on a charge of offering violence to a guard of the Department of Corrections, an offense defined by Section 216.460, RSMo 1959, V.A.M.S. A jury found the appellant guilty and the court, acting under the Habitual Criminal Act, fixed his punishment at five years in' prison. After a motion for new trial had been overruled, an appeal was taken to this court. Appellant was represented by court-appointed counsel in the circuit court.
