This was an action in replevin, commenced by the defendant in error, plaintiff below, against the plaintiff in error, u as sheriff, defendant below, for the purpose of recovering the immediate possession of certain oil well casing. In his petition the plaintiff alleged that he was the owner of, and entitled to, the immediate possession of certain oil well casing, and that the de fendant, as sheriff of Tillman county, was wrongfully detaining possession thereof.
