PETERS, District Judge.

Upon a complaint by the United States alleging violation of the Radio Law, the defendant has been bound over to await the action of the grand jury at the present term of this court. Anticipating an indictment, he has filed two motions; one alleging an illegal search by federal officers of a dwelling occupied by him and the seizure of certain property there, the suppression of which as evidence is asked for; and the other asking-for the return of the same property to his possession.
