Error to Marquette; Stone, J. - Ejectment by Frank Hoffman against George Silver-thorn and Perry F. Powers, auditor general. There was ' judgment for plaintiff, and defendants bring error.

This is an action of ejectment. It was tried by the court below without a jury, who made a finding of facts, and rendered judgment for the plaintiff. We state such of said facts as are necessary to an understanding and disposition of the legal questions raised on this appeal:

“Said Frank Hoffman is the owner in fee simple of” the lands in controversy, “having acquired the original or * government title- thereto.
