Dan M. Williams, defendant below and appellant herein, was, during the year 1926, a dealer in automobiles in the City of Easton, trading under the name of Williams Motor Company. Among other cars on the floor of his show room on June 10, 1926, was a certain Chevrolet sedan. On that date Williams sold this car to Henry B. Shultz, receiving in exchange therefor an old car belonging to Shultz, valued at $50, and $882 in money. The money received by Williams for the car was applied by him to his own use.
