This action was instituted for the recovery of damages by reason of the breach of a contract of employment resulting from a dismissal of respondent by appellant. Respondent is the owner and captain of the gas boat “Service,” and entered into a written contract whereby he chartered the boat to appellant for the period beginning April 15 and ending October 1, 1922, inclusive, for which he was to receive the sum of $30 a day.
