ORDER GRANTING SUMMARY JUDGMENT

MORRIS, Chief Judge.

This declaratory judgment action is before the court on plaintiff’s motion for summary judgment. Plaintiff has filed a brief in support of the motion, to which defendants have filed a response. Plaintiff has filed a reply to defendants’ response. In accordance with the court’s order of September 29, 1977, the depositions of defend ants Lancie Smith and Patricia Smith, upon which plaintiff relies in support of its motion, have been filed with the clerk of the court.
