The appellant was indicted for the offense of robbery and after counsel was appointed a plea of not guilty was entered. The trial resulted in a verdict and judgment of guilty and punishment was fixed at ten years in the penitentiary.

The prosecuting witness and alleged victim testified in substance that on April 1, 1970, he parked his car on First Street in Fort Payne, DeKalb County, Alabama, and that the appellant drove up and parked his car beside him; that the appellant got out of his car and got into the back seat of the witness’s car and told him that he owed him three dollars; that the…
