Alexander Garrow and Ernest D. Garrow, plaintiffs, filed their petition in the district court against the Farmers’ Bank of Nebraska City and the Union Bank of Union, defendants. The essential allegations of the petition, so far as material at this time, are as follows: That on or about the 24th day of June, 1895, the plaintiffs entered into a contract with one Frank P.
