Upon this appeal from an order sustaining defendant’s plea in abatement to an information charging him with manslaughter in the fourth degree, under sec. 340.26, Stats. 1929, the sole issue presented is whether or not the evidence introduced on the preliminary examination established the commission of the crime charged and a reasonable *160probability of the commission thereof by the defendant.
