Appeal1 from order overruling plaintiff’s objections to a hearing of an action to establish a trust, and to the trial of any issue of fact by Honorable Aylett R. Cotton.

On November 16, 1946, plaintiff filed a complaint against defendants in the Superior Court of San Mateo County, to establish a trust in his favor as to an undivided half interest in the estate of Daniel McSweeney, deceased, then in course of probate in the same court.
