The plaintiff in error, Christine Conzo, in response to a subpoena, appeared before the grand jury in Cook county on January 10,1939. After she was sworn as a witness and after giving her name and address, she declined, ‘ ‘ on advice of counsel, ’ ’ to answer further questions. She was then served with another subpoena, which required her to appear on the following day. At that time, accompanied by the grand jury, she appeared in open court.
