NAUGHTON, Judge:

Contrary to Ms pleas, appellant was convicted of assault with intent to commit sodomy and sentenced to confinement at hard labor for five years. The convening authority approved the sentence. The court-martial arose out of an incident at the United States Disciplinary Barracks where appellant and his victim, Private V, were confined. On the day of the offense, Private V was awakened by appellant, who was sitting on his chest and running his penis across Private V’s face.
