Aspen Technology (Aspen) sued Tekin Kunt, a former employee, for violating a noncompete clause in his employment contract. It subsequently added Kunt’s new employer, M3 Technology (M3), as a defendant and, brought claims for tortious interference with contract, trade secret misappropriation, and copyright infringement. A jury found in favor of Aspen and the district court issued a permanent injunction. M3 appeals the district court’s denial of its motion for judgment as a matter of law as to Aspen’s misappropriation and infringement claims and further appeals the damages award…
