Tlie Bank of Columbia obtained a judgment in the Taylor circuit court against the county of Taylor for tbe sum of $4,000, and interest at tire rate of 6 per cent, per annum from the 29th of March, 1894, until paid. Afterwards it moved the fiscal court to make *228a levy to pay the judgment. This the fiscal court declined to do. Thereupon the bank instituted an action against the members of that court to compel them to make the levy. The court below refused to require the fiscal'court to make the levy prayed for.
