JOHNSON, District Judge.

The petitioner, Ralph Keene, on or about July 1, 1963, presented to this Court his application for leave to file and proceed in forma pauperis on his petition for a writ of habeas corpus. Upon consideration thereof, this Court, on July 1, 1963, directed that said petition for a writ of habeas corpus be filed without the prepayment of fees and costs and further ordered and directed that William C. Holman, Warden, Kilby Prison, Montgomery, Alabama, appear and show cause why this Court should not order the writ of habeas corpus issued. As directed by this Court, William…
