Reversing.

This is an action on a supersedeas bond executed by J. R. Walker, as principal, and the American Bonding and Trust Company, of Baltimore City, as surety, to John Dowling, in a forcible detainer proceeding between Dowling and Walker to recover possession of a distillery plant and fifteen acres of land situated in Anderson county, Ky. The facts out of which this litigation grows are substantially as follows: Walker owned the distillery plant anff land, and executed a mortgage upon it to Dowling to secure borrowed money.
