Factual Background

On June 2, 2005, acting on information from a confidential informant, Lieutenant Paulo Leuma (“Lt. Leuma”) prepared an affidavit and application for a warrant to search the residence of Pepe Lam Yuen (“Pepe”).1 The affidavit notes that the confidential informant (the “Cl”) witnessed Pepe and his wife, Kolopa Lam Yuen (“Kolopa”)2 (collectively “Defendants”) selling marijuana from their home and trading marijuana for valuable items between January 2005 and May 2005.
