Plaintiff had a verdict, and defendant appeals from the order denying his motion for judgment notwithstanding or a new trial.

The automobile collision here involved took place at the intersection of Palace and Finn streets in St. Paul early in the afternoon of January 9, 1929. Both streets were unpaved and Palace the more traveled of the two. There was a little snow on the ground, and a mist was falling which had a tendency to freeze as it fell, particularly on the windshield and other glass of automobiles.
