OPINION

PATEL, District Judge.

Plaintiff Barbara Jackson brings this action under the Emergency Medical Treatment and Active Labor Act of 1986 (“EMTALA”), 42 U.S.C. section 1395dd, state law and 42 U.S.C. section 1983, for damages arising from the wrongful death of and personal injury to her husband, Robert Jackson. Plaintiff and defendants have filed cross-motions for partial summary judgment on the applicability of state law damages restrictions to plaintiffs claim.
