This matter again is before the court on Jeffrey MacDonald’s “Motion to Reopen 28 U.S.C. § 2255 Proceedings and for Discovery,” filed April 22, 1997 (“motion to reopen”). MacDonald has filed an extensive memorandum of law and hundreds of pages of affidavits and exhibits in support of his motion to reopen. In response, the Government filed on May 12, 1997, a motion to dismiss and suggestion, in the alternative, to transfer the matter to the Court of Appeals, along with a memorandum of law.
