I. FACTUAL BACKGROUND

The present action concerns an alleged violation, of plaintiffs Fourteenth Amendment due process rights by parties acting under color of state law, brought under 42 U.S.C. § 1983, and a claim that 9 NYCRR § 4117.4(p) is unconstitutional. Plaintiff William 1 Parker, Jr. is a New York State licensed harness race driver.
