The industry of counsel has not unearthed a precedent for an action resembling this in some of its phases. The city council of Aspen passed an ordinance purporting to grant to The Aspen Water and Light Company the exclusive right to furnish water and light to the city, and then attempted, according to the plaintiff’s contention, to modif}' and repeal the franchise. The suit is for the damages resulting from this alleged legislative action.
