Error to District Court of Arapahoe County. The action was instituted in the name of “The Arkansas Biver, Land, Town and Canal Company, a corporation: John W. Gaynor, Peter O. Gaynor, J. O. Abbott, J. F. Minnis, stockholders,” etc., plaintiffs, against “The Farmers’ Loan and Trust Company, Hugh Butler, A. B. McKinley and Otis L. Haskell,” defendants. It appears from the record in this case that in the month of December, 1883, the individual plaintiffs above named set on foot an enterprise, the object of which was the construction and maintenance of an irrigating canal in the valley of the Arkansas river, the acquisition and sale of lands, and other kindred purposes.
About the time mentioned the parties named, or some of them, went to the county of Bent, located and made a preliminary survey of a portion of the line of the proposed canal. The object of this step appears to have been to provide data for a description of the…
