— This is an original action by which relator, State of Indiana sought an alternative writ of mandamus and a temporary writ of prohibition. We granted this temporary writ, directing respondent Judge Richards to refrain from exercising further jurisdiction over this cause, and to nullify his former orders in this cause which suspended the sentence of convicted defendant David Gubitz.
