Appellant Downs was convicted of second-degree murder at the conclusion of a jury trial in Clark Circuit Court on August 13, 1975. He was sentenced to imprisonment for fifteen to twenty-five years.

The evidence at trial revealed that appellant, who was the chief of the New Albany Police Department, was separated from his wife at the time of the murder in question. On the evening of March 28, 1974, appellant wanted to meet his wife at his office.
