Appeal from a judgment and order of the Court of General Sessions of the Peace in and for the county of New York, entered on the 18th day of April, 1911, sustaining a demurrer to an indictment charging defendant with a violation of section 290, subdivision 3, of the Highway Law,* as added to the law by chapter 3'74 of the Laws of 1910. Judgment and order affirmed on the opinion of the court below. (Reported in 70 Misc. Rep. 433.)
