The plaintiff in error, hereinafter called defendant, was convicted of embezzlement in the district court of Rogers county, and was sentenced to serve a term of 15 years in the state penitentiary and to pay a fine of $4,000.
The record discloses that at the time charged and for some two years prior thereto defendant was cashier and director of the Farmers’ & Merchants’ Bank of Catoosa, and while such cashier he appropriated to his own use and embezzled an item of money coming into his hands and intrusted to him as such cashier in the sum of $300.
